This bill expands existing highway safety requirements to provide greater protection for stationary vehicles with warning lights or devices. Currently, drivers are required to exercise caution when approaching a stationary marked California Department of Transportation (Caltrans) vehicle with flashing lights, either changing lanes away from the vehicle or slowing down to a safe speed. The bill broadens this requirement to include all marked highway maintenance vehicles (defined as vehicles owned or operated by state, county, municipal, or contractor entities responsible for road maintenance) and any other stationary vehicle displaying flashing hazard lights or warning devices like cones, flares, or retroreflective markers. Drivers must either change lanes away from the stationary vehicle if it is safe and legal to do so, or slow to a reasonable and prudent speed considering weather, road, and traffic conditions. The bill maintains the existing penalty of an infraction punishable by a fine of up to $50. The legislation also specifies that these requirements do not apply if the stationary vehicle is not adjacent to the highway or is separated by a physical barrier. Notably, the bill includes a provision stating that no reimbursement is required because the act creates a new infraction, which is consistent with California's constitutional requirements for state-mandated local programs.
